These terms apply to the factumagency.com website. The specific work we do for a client is agreed separately, in writing.
What we do
FACTUM Agency provides marketing services to home service businesses: Google Business Profile setup and management, review collection, missed-call capture and response, websites, and paid local advertising. What is included for you is set out in your own written agreement, which controls if it differs from anything on this site.
No guarantee of results
We do not guarantee rankings, call volume, lead quality, revenue, or any other outcome. Search engines, ad platforms, and review platforms are controlled by third parties who change their rules, timelines, and pricing without consulting us. We will tell you what is realistic and what is slow before you pay; we will not promise a number.
Fees and billing
Work is billed month to month. There is no setup fee and no long-term contract. Prices shown on this site are indicative until confirmed for your trade and your market. Third-party costs you incur directly — advertising budgets, domain registration, platform fees — are yours and are not part of our fee unless your agreement says so.
Cancellation
Either side may end the arrangement with notice, effective at the end of the current paid month. We do not charge a termination fee. Your Google Business Profile, your domain, your phone number, your reviews, and your customer records remain yours.
Exclusivity
We work with one client per trade per market. While you are a client, we will not take on a direct competitor in the same trade in the same market.
Your responsibilities
You confirm that the business details, licenses, and insurance information you give us are accurate, and that you have the right to the photos and text you send us. Platform rules — Google's in particular — require accurate business information, and false details can get a profile suspended.
Site content and liability
Content on this site is provided as-is for general information. To the fullest extent permitted by law, FACTUM Agency is not liable for indirect or consequential losses arising from use of this site.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Santa Clara County, California.
